I need a name for a software product I'm building.?

I'd like to protect my name with a trademark. I found a cool name where both the URL and trademark (according to the USPTO.gov site) are available. However, someone wrote a book with the same name as their title a few years ago. do the copyright privileges of the author stop me from pursuing that name for my software?
